By downloading, accessing, purchasing, or using VocaNum, you agree to these Terms and the VocaNum Privacy Policy. If you do not agree, do not use VocaNum. Mandatory rights available to you under applicable consumer law are not excluded by these Terms.
1. The VocaNum service
VocaNum provides vocabulary-learning, measurement, practice, progress, personalization, and related features. Features may depend on your device, operating system, region, Apple services, network availability, subscription status, or the version of VocaNum you are using.
VocaNum may add, modify, replace, limit, suspend, or discontinue features, content, plans, technical methods, eligibility rules, or portions of the service at any time, subject to applicable law and any obligations attached to an existing paid entitlement.
2. License and permitted use
Subject to these Terms, VocaNum grants you a limited, personal, revocable, non-exclusive, non-transferable license to use VocaNum for lawful personal purposes on supported devices.
You may not, except where applicable law expressly permits it:
- copy, sell, sublicense, rent, distribute, or commercially exploit VocaNum;
- reverse engineer, decompile, bypass, probe, or interfere with security or access controls;
- scrape, harvest, automate, or extract VocaNum content or data at unreasonable scale;
- circumvent purchase, entitlement, usage, rate, or feature restrictions;
- use VocaNum to violate law, third-party rights, or platform rules;
- impersonate VocaNum or misrepresent an affiliation with VocaNum; or
- introduce malicious code or disrupt VocaNum infrastructure or other users.
3. Intellectual property and reserved rights
VocaNum and its software, interfaces, designs, branding, text, questions, datasets, scoring and selection systems, graphics, workflows, documentation, and other original materials are owned by or licensed to VocaNum and are protected by applicable intellectual property and other laws.
No ownership right is transferred to you. Except for the limited license expressly granted in these Terms, all rights, title, interests, remedies, and claims relating to VocaNum are expressly reserved.
4. VocaNum Pro, purchases, and subscriptions
VocaNum may offer subscriptions, lifetime purchases, trials, promotional access, or other paid entitlements. Available products, prices, currencies, benefits, eligibility, and promotional terms may vary by storefront, region, time, or user and may change where permitted by law.
Purchases made through Apple are processed by Apple. Apple’s billing, renewal, cancellation, refund, tax, and account-management rules apply to those transactions. VocaNum does not receive your full payment-card or banking credentials.
Auto-renewable subscriptions continue until cancelled through the applicable Apple account settings. A lifetime entitlement, where offered, means access to the applicable VocaNum entitlement for the supported life of that product or service; it does not guarantee that every future product, platform, feature, service, or separately offered item will be included forever.
5. Trials, promotions, and offers
VocaNum may offer trials, discounts, referral benefits, complimentary access, campaigns, or other promotions. Such offers may have separate eligibility requirements, durations, limits, or conditions and may be modified or withdrawn where permitted by law. Unless expressly stated otherwise, promotional access has no cash value and may not be transferred or resold.
6. Learning results and informational nature
Vocabulary estimates, confidence values, progress indicators, recommendations, rankings, and other learning outputs are product features intended to support learning. They are estimates and may be affected by question selection, user behavior, available data, software changes, and other factors.
VocaNum does not guarantee any particular educational, examination, employment, certification, fluency, or other outcome. VocaNum is not a substitute for professional educational, medical, legal, or other professional advice.
7. Availability, updates, and third-party services
VocaNum may rely on Apple and other service providers for hosting, distribution, purchases, synchronization, infrastructure, or other functionality. VocaNum is not responsible for outages, restrictions, changes, or failures caused by services outside VocaNum’s reasonable control.
You may need to install updates to continue using some features. VocaNum does not promise that every feature will remain available on every device, operating-system version, or region.
8. User data and backups
You are responsible for maintaining appropriate device access, backups, and account security. Features involving local storage, synchronization, restore, reset, import, export, or deletion can result in data being changed, replaced, or removed. Review available confirmations and backup options before performing destructive actions.
VocaNum does not guarantee that data can always be recovered after deletion, device loss, corruption, service failure, account changes, or unsupported modifications.
9. Enforcement and suspension
VocaNum may restrict, suspend, refuse, or terminate access to all or part of the service where reasonably necessary to protect VocaNum, users, infrastructure, legal rights, platform compliance, or service integrity, including in cases of suspected fraud, abuse, circumvention, unlawful conduct, or material breach of these Terms.
10. Disclaimers
To the maximum extent permitted by applicable law, VocaNum is provided on an “as is” and “as available” basis. VocaNum disclaims warranties and representations that are not expressly required by law, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, accuracy, or error-free operation.
11. Limitation of liability
To the maximum extent permitted by applicable law, VocaNum will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, loss of profits, loss of opportunity, or business interruption arising from or relating to use of or inability to use VocaNum.
Where liability cannot lawfully be excluded, VocaNum’s liability will be limited to the extent permitted by applicable law. Nothing in these Terms excludes liability or rights that cannot legally be excluded or limited.
12. Apple platform terms
If you obtain VocaNum through Apple’s App Store, Apple’s applicable App Store, media-services, subscription, refund, device, and license terms may also apply. Where mandatory Apple platform terms conflict with these Terms for an Apple-provided service, the mandatory Apple terms control for that service.
13. Changes to these Terms
VocaNum may revise these Terms to reflect changes to the product, services, business, technology, risk, or legal requirements. The current version will be published on this page. Continued use of VocaNum after an update constitutes acceptance to the extent permitted by applicable law.
14. General terms
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law. Failure by VocaNum to enforce a provision is not a waiver of that provision or any other right. VocaNum may assign or transfer rights and obligations relating to the service as part of a reorganization, transfer, financing, merger, acquisition, sale, or other lawful business transaction, subject to applicable law.
These Terms are governed and interpreted under the laws that apply to the relevant relationship and transaction, without limiting any mandatory consumer protections or jurisdictional rights that cannot lawfully be waived.
